Avoiding Probate

A living trust  is an estate planning solution that can help your heirs avoid probate after your death.  When you create the trust you are referred to as a settlor or trustor.  The living trust (also known as a revocable trust) avoids the necessity of probate by receiving the transfer of the settlor’s assets into the living trust.  A trustee, which can be the same individual as the settlor, is legally responsible ( called the fiduciary duty) to manage the trust assets for the beneficiaries of the trust.   During the the settlor’s lifetime, the beneficiary can also be the beneficiary of the trust.  When the settlor  dies a successor trustee takes over the fiduciary duty to carry out the terms of the trust for the beneficiaries.  Since assets are transferred to the trust before death there is no need for the legal process of probate to transfer assets to a decedent’s  heirs as the trust continues in existence.

Life Insurance Trust:  If you own a life insurance policy on your own life the proceeds of that policy will be included in your taxable estate when you die. This can be avoided by creating an irrevocable life insurance trust (ILIT).  Ownership of the police is transferred to the trust which can remove the life insurance proceeds from the estate.
